This website, velthorna.com (the "Site"), is operated by Ascendyx LLC ("Velthorna", "we"). By visiting the Site or purchasing from us, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Site.

1. Incorporated policies

Our Refund & Return Policy, our Shipping Policy, and our Privacy Policy form part of these Terms and are incorporated by reference. These policies are available on every page of the Site and at checkout. By completing a purchase, you confirm that you have read and accepted them.

2. Products, descriptions, and prices

We make every effort to display our products, colors, and descriptions accurately. Slight color variations may occur due to screen settings and product batches; these variations are not defects. All prices are in U.S. dollars. We reserve the right to correct pricing or listing errors, to change prices, and to cancel and refund any order affected by an obvious error, even after an order confirmation has been sent. Promotional discounts apply as shown at checkout and cannot be applied retroactively.

3. Orders, acceptance, and rejection

Your order is an offer to purchase. We reserve the right to accept, limit, or reject any order at our sole discretion, including orders that appear to be placed by resellers, orders with mismatched billing information, orders flagged by our fraud-prevention systems, and orders to addresses with a history of payment disputes. If we cancel an order, we refund the full amount paid.

4. Chargebacks and payment disputes

You agree to email us at support@velthorna.com and give us 7 business days to resolve any issue before initiating a chargeback or payment dispute. We respond to every support request. Chargebacks filed in violation of this section, including disputes on orders with confirmed delivery to the address provided at checkout, will be disputed with full transaction evidence (order data, AVS/CVV results, checkout policy disclosure, delivery confirmation, and support correspondence). We reserve the right to recover the costs and fees arising from illegitimate chargebacks, to report friendly fraud to the relevant fraud-prevention networks, and to decline future orders from customers who have filed illegitimate disputes.

5. Shipping and risk of loss

Shipping is governed by our Shipping Policy. Risk of loss passes to you upon carrier- confirmed delivery to the address provided at checkout. Optional Shipping Protection is available at checkout and covers loss, theft, and in-transit damage as described in the Shipping Policy.

6. Warranties and disclaimer

Products are offered "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, beyond the product descriptions on the Site, including the implied warranties of merchantability and fitness for a particular purpose. Nothing in these Terms limits rights that cannot be limited under applicable law, including the remedies for defective products provided in our Refund & Return Policy.

7. Limitation of liability

To the maximum extent permitted by law, Ascendyx LLC's total liability arising out of or relating to any order is limited to the amount you paid for that order. We are not liable for indirect, incidental, special, or consequential damages, including delays outside our control.

8. Intellectual property

All content on the Site, including text, images, graphics, and design, is the property of Ascendyx LLC or its licensors and may not be copied or used without prior written authorization.

9. Governing law

These Terms and any dispute arising from your use of the Site or any purchase are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws principles and excluding the United Nations Convention on Contracts for the International Sale of Goods.

10. Binding arbitration and class-action waiver

Any dispute that cannot be resolved through our support team will be resolved by binding individual arbitration administered by a recognized arbitration provider under its consumer rules, and not in the courts, except that either party may bring an individual claim in small claims court. You and Ascendyx LLC waive the right to a jury trial and the right to participate in a class action. Disputes must be brought only on an individual basis. You may opt out of this arbitration clause by emailing support@velthorna.com within 30 days of your first purchase.

11. Changes to these Terms

We may update these Terms at any time. Each order is governed by the version published on the Site at the time it is placed. Continued use of the Site after a change constitutes your acceptance.
